On August 21st of 2013 the Tula regional court revoked the administrative expulsion of Syrian citizens Ayman Alnahhas, Diaa Ekko, Khusin Khasso, Kutaib Hazm and Youssef Lababidi. On the 9th of August they were all accused of administrative violations. On the same day the Soviet District Court ordered the Syrians should be deported, with a fine of 2,000 rubles.

As soon as the month of Ramadan ended and the celebrations of Eid al-Fitr were over, Ingushetia returned to their problems. Chechnya: Dispute over Land in Davydenko Village Continues

In the summer of 2012, the administration staff of the Achkhoi-Martan district and Davydenko village demanded that the villagers sign a lease for the land on which their houses stand, which  they own according to property rights. In fact, the people were forced to admit that the land is not in their permanent use, as it is defined by law, but belongs to the administration and therefore they cannot legalize the ownership of land by simply registering it.

They reported that on the night of August 5th houses of three residents of the village, practicing the Salafi branch of Islam, were burnt down. Owners of houses had previously left the village: their names were included in the "hit list" and they feared persecution.

Mikhail Valentinovich Savva, born 1964, - member of a nonprofit organization “Southern Regional Resource Center”, deputy chairman of The Public Monitoring Committee (Obshestvennaya Nabludatelnaya Komissiya) of Krasnodar Krai, an honored professor of Kuban State University, Doctor of Political Science, PhD in Sociological Science. Accused of part 1 Article 159 (swindling) and part 3 Article 159.2 (swindling in obtaining payments by using his official position on a large scale) of the Criminal Code of the Russian Federation, he is currently remanded in isolation ward.

On 18 April 2013 in Arshty village, Sunzhensky district, Republic of Ingushetia, a confrontation between Chechen and Ingush siloviks took place. ECHR for the First Time Found Law-Enforcement Authorities of “Kadyrov”-Chechnya Responsible for a Man's Abduction

On 18 April 2013 the European Court of Human Rights (ECHR) delivered a judgment on the application “Askhabova v. Russia” (app.no. 54765/09). The applicant is Tamara Askhabova residing in Shali city, Republic of Chechnya, whose son Abdul-Yazit was unlawfully detained by officials of the Republic’s law-enforcement agencies in 2009 and subsequently disappeared.

In relation to changes in legislation, assumed on 30th December 2012, the investigator did not attempt to prolong the length of the detention.

Chechnya: Counter-Terrorism Routine, End 2012

Within the last three months of 2012 Chechen Interior Ministry officers carried out several operations aimed at seizing the accomplices of militants in the Chechen village of Assinovskaya. As part of the counter-terrorism efforts, at least 16 young men residing at the village were illegally detained or abducted. Mostly, neither those abducted nor their relatives are willing to elaborate and are reluctant to file official complaints.

Prosecutor’s Office Closes the Case of Slaves in the Moscow Suburb Golianovo

On November 14, 2012 Damir Semerhanov, the investigator for Moscow’s Preobrazhenskoe Interdistrict Presecutor’s Office informed Emil Taubulatov, one of the attorneys to the women who were recently freed from slavery in the Golianovo district of Moscow, that the said Prosecutor’s Office annulled the case of Unlawful deprivation of liberty under the Article 127.2.Zh of Russia’s Criminal Code, due to “absence of crime in the act”. The Preobrazhenskoe Investigation Division disagrees with this decision and will appeal it at a higher standing Prosecutor’s Office of Moscow’s East administrative region.

Kremlin Strengthens Pressure on Muslim Groups

On November 7, 2012 Moscow and its outlying suburbs saw a high number of arrests and searches connected to a case launched against the organization Hizb ut-Tahrir, accused of Organized Activity of an Extremist Organization Banned by a Court decision, Article 282.2 of the Russian Criminal Code earlier that month. The large-scale operation started between five and six in the morning and involved officials of special operation units as well as tens of armed fighters of the Special Forces. According to different sources, the number of arrests counted between thirty to seventy persons, some of whom were released following an interrogation by the Federal Security Service. The arrests and the searches, as well as the unexpected new tougher charges against “Hizb ut-Tahrir” in the city of Cheliabinsk at the end of July could be barely seen as part of the special services’ routine practices of countering extremism and are likely signifying Vladimir Putin’s government attempts to take up a visibly tougher policy towards the Islamic community.

Former Policeman Il’ez Nal’giev is to serve eight years in jail after the judge found him guilty of torturing Zelimkhan Chitigov. Ingushetia: Hunger Strike Lands Five Protesters in Jail

Police in Ingushetia dispersed protesters who were staging a hunger strike. Five of them ended up in jail for an administrative offence. The protesters, belonging to Ingush opposition, called on the leadership of Ingushetia to resign. They also demanded that the state complies with the law “On Rehabilitation of the Repressed Peoples,” which dates back to 1992.

Regardless of whether the abduction was with the assistance of Ukrainian agencies or was the result of the relevant agencies’ inability to prevent the activities of foreign agents on Ukrainian territory, this case serves to confirm the deep crisis in the organization of activities by the authorities responsible for safeguarding Ukraine’s sovereignty. It is a worrying indication that the authorities are incapable of ensuring security and legal order in Ukraine.

On October 13, 2012 Interfax news agency circulated a report saying that "the agencies within the FSB put an end to the activities of 20 NGOs of Ingushetia which had been caught contacting with intelligence services of foreign governments and collecting intelligence data.

Dagestan: Two More Policemen on Trial for Beating Teenager

On October 4, 2012, a hearing began in the Khebda village court, Shamilskiy district, the Republic of  Dagestan. Standing the trial are Mr. Gamzat Nurudinov and Mr. Shamil' Magomedaliev, two of the the three Shamilskiy District Police Department officers charged with beating a minor, Mr. Makhmud Akhmedov, at the police station in 2010. The case of the third police officer, Mr. Magomed Magovemdov, was set apart into a separate proceeding, and in the summer 2012 he was sentenced to three years’ imprisonment. Mr. Magomedov appealed the judgment, but it was upheld in September this year by the Dagestani Supreme Court.

Ingushetia: Judgment into Karbulak Police Abuses Expected Tomorrow

On Tuesday, October 9, 2012, at 15:00 the Karabulak Disctrict Court, the Republic of Ingushetia, is to announce its judgment into the case of former Karabulak District Police Department Chief, Mr. Nazir Guliev, and his ex-deputy Mr. Ilez Nal'giev. Mr. Guliev is accused of exceeding official powers. His former deputy, Mr. Ilez Na'giev is accused of inflicting heavy injuries. It was not a mere co-incidence that the verdict has been delayed several times. The well-connected defendants possess considerable material means. They also have the advantage of lacking any ethical restraints. It remains to be seen whether the judge will have the courage to proclaim the defendants guilty.

Ingushetia: the Pronouncement of the Court Sentence in the Case of Criminal Policemen Postponed Again

The court judgement into the case of ex-head of the Karabulak district police department Nazir Guliev and his ex-deputy Ilez Nal'giev was scheduled to be pronounced on September 28, 2012, at 3 p.m. Mr. Guliev is accused of abuse of power while Mr. Nal'giev is charged with insult and infliction of a grave injury. Earlier, the pronouncement date had been set for July 17. However, within the last two and a half months it has been being postponed several times and did not take place on September 28 either.

Russian Human Rights Activists Urge PACE to Re-Consider Draft Resolution

On Tuesday, October 2, 2012, the Parliamentary Assembly of the Council of Europe is to meet to discuss the honouring of its obligations and commitments by the Russian Federation. Earlier, PACE’s Monitoring Committee has unanimously adopted a resolution on the issue which was based on the report by PACE rapporteurs, Mr. György Frunda (Romania), and Mr. Andreas Gross (Switzerland). The resolution has been in the centre of attention of Russian NGOs. Their representatives, including Memorial HRC’s Oleg Orlov, say that while the draft text contains a number of potentially beneficial recommendations to the Russian authorities, it regrettably comes short of identifying the underlying issues, such as a mere imitation of reforms disguised as “liberalisation,” the continuing human rights abuses in Chechnya, and the degrading treatment of women in the North Caucasian republic.

Council of Europe’s Committee of Ministers to Consider Russia’s Failure to Implement the European Court judgments Concerning Heavy Civilian Losses in the Bombings of Katyr-Yurt, Chechnya

On August 1, 2012, the Human Rights Centre Memorial (Moscow) and the European Human Rights Advocacy Centre (EHRAC, London), submitted an application to the Committee of Ministers of the Council of Europe to initiate infringement proceedings against Russia under Article 46 of the European Convention for the Protection of Human Rights and Fundamental Freedoms for a continuous failure to conduct an effective investigation into the bombing of the village of Katyr-Yurt in Chechnya in 2000 by the federal armed forces resulting in heavy civilian losses. The mechanism enables the Committee of Ministers of the Council of Europe to refer a case back to the Court where a respondent State fails to comply with the Court’s binding judgment. The Committee of Ministers is to meet to discuss the issue on September 24—26, 2012, in Strasbourg.

Media Release: Infringement Proceedings against Russia Resulting from Human Rights Violations in Chechnya

Human Rights Centre Memorial and the London-based European Human Rights Advocacy Centre (EHRAC) have launched a unique application to bring ‘Infringement Proceedings’ against the Russian Federation for failing to investigate or find those accountable for the bombing of the village of Katyr-Yurt, in Chechnya, in February 2000. Infringement Proceedings is a new mechanism, introduced in 2010, allowing the Committee of Ministers of the Council of Europe to bring a case back to the European Court of Human Rights where the State has failed to comply with a judgment.
